The Mrs Edit – Consignment Agreement
1. Agreement to Consignment Terms
By consigning a garment with The Mrs Edit (TME), the consignor agrees to the terms outlined in this Consignment Agreement. A signed consignment contract is required for all items accepted for sale. The consignor is responsible for retaining a copy of the agreement. Failure to retain a copy does not invalidate or exempt the consignor from these terms once the garment has been left in the care of The Mrs Edit.
2. Consignment Period
- The standard consignment period is 12 months from the date the garment is accepted into store.
- If the consignor chooses to withdraw the garment prior to the completion of the 12-month period, an administration fee of $200 will apply.
- During the consignment period, The Mrs Edit retains exclusive possession and authority to display, market and sell the garment on behalf of the consignor.
- If the garment does not sell within the 12-month period, The Mrs Edit may offer a month-to-month extension or request collection of the item.
- The consignor must collect the garment within 30 days of notification. A storage fee of $50 per week will apply thereafter.
- If the garment remains uncollected after 60 days, The Mrs Edit reserves the right to resell or otherwise dispose of the item without compensation to the consignor.
- Alternatively, The Mrs Edit can return the garment via post at the consignor’s expense. Requests for postal return must be submitted in writing via email, and the shipping invoice must be paid within the 30-day notification period.
3. Condition of the Garment
- All garments must be presented clean and in sellable condition.
- If dry cleaning, repairs or steaming are required, The Mrs Edit may arrange these services at the consignor’s expense.
- The Mrs Edit reserves the right to refuse any item based on condition, style, sizing, or current market demand.
· While every reasonable care is taken in handling all garments, consigned items may be tried on during private appointments and minor wear consistent with fittings is considered normal and accepted.
· The Mrs Edit holds insurance that may provide limited coverage for loss or damage to certain consigned garments resulting from events such as theft, fire or flood while the garment is in our possession. Coverage is subject to the terms, conditions and limits of the insurance policy.
· The Mrs Edit does not guarantee that all consigned items will be covered, nor that any insurance pay-out will reflect the original retail value or agreed consignment price. To the extent permitted by law, The Mrs Edit is not liable for loss or damage beyond any insurance proceeds received.
4. Pricing & Payment
- The consignor will receive 65% of the final sale price, with The Mrs Edit retaining 35% commission.
- All pricing is agreed upon at intake; however, market demand may require adjustments.
- If interest is limited or during promotional sale periods, The Mrs Edit may propose a price reduction via email.
- If no response is received after three email attempts over a 14-day period, The Mrs Edit reserves the right to apply a reasonable discount below the originally agreed price.
- Commission remains calculated on the final sale price, regardless of any discount applied.
- The consignor will be notified via email once the garment is sold.
- Payments are processed monthly and made via direct deposit.
5. Advertising & Marketing
- The consignor may continue to advertise their garment independently; however, the advertised price must match The Mrs Edit’s listing price, and all enquiries must be directed to The Mrs Edit.
- If the consignor sells the garment privately during the consignment period, The Mrs Edit is entitled to the full commission based on the agreed sale price.
- The consignor must supply at least one high-quality image of the garment for online marketing purposes.
- The Mrs Edit reserves the right to use any consigned or owned garment for styling, promotional wear, photography, and marketing purposes without notice or compensation.
- Any imagery or media created by The Mrs Edit remains the exclusive property of The Mrs Edit and may be used for marketing and promotional activities.
6. Communication & Updates
- Due to stock volume, The Mrs Edit does not provide routine updates regarding enquiries or fittings.
- Consignors may request an update after six months, at which time a price review may be discussed.
- The consignor agrees to receive all communications via email and is responsible for ensuring their contact details remain current.
- If the consignor cannot be reached, The Mrs Edit is not liable for pricing decisions, storage fees, or sale outcomes.
7. Final Agreement
By consigning a garment with The Mrs Edit, the consignor confirms they have read, understood, and agreed to these terms.
